Telefonzellen, Bob Dylan und der U.S. Supreme Court

Der österreichische Oberste Gerichtshof hat Bob Dylan schon in einer Entscheidung aus dem Jahr 2000 (4 Ob 173/00w) namentlich genannt - allerdings nur, weil er in einer Urheberrechtssache als Privatankläger aufgetreten ist (das Trauma von Great White Wonder wirkt offenbar nach). Im U.S. Supreme Court ist Bob Dylan nun - nach einer ersten Erwähnung im Jahr 2003 in einer Fußnote (Seite 17, ebenfalls in der Rolle als Kämpfer für ein strenges Urheberrecht) - endlich auf der Ebene der zitierten Autoritäten angelangt.

Der am 23. Juni 2008 entschiedenen Sache Sprint v. APCC liegt wieder einmal eine Streitigkeit zwischen Long Distance Carrier und Payphone Service Providers zugrunde (SCOTUS Blog spricht von der "curious industry of payphones"). Das grundsätzliche Verhältnis sollte seit der Sache Global Crossing (Entscheidung vom 17. April 2007) geklärt sein, die nun entschiedene Sache betraf keine telekomrechtliche Fragestellung, sondern die Zulässigkeit der Prozessführung durch ein Unternehmen, dem die einzelnen Payphone-Betreiber ihre jeweiligen Forderungen gegen Sprint zur Einziehung abgetreten hatten (assignments for purposes of collection). Im common law offenbar eine schwierige Frage, die in der Mehrheitsmeinung historisch aufgearbeitet wird ("As the 17th century began ..."). Die dissenting opinion, von Justice Roberts verfasst, legt schon einleitend Grundlegendes dar: "There is a legal difference between something and nothing." - woraus schließlich auch zwanglos ein Dylan Zitat folgt:

"The payphone operators assigned their claims to respondents 'for purposes of collection,' ... respondents never had any share in the amount collected. The absence of any right to the substantive recovery means that respondents cannot benefit from the judgment they seek and thus lack Article III standing. 'When you got nothing, you got nothing to lose.' Bob Dylan, Like A Rolling Stone, on Highway 61 Revisited (Columbia Records 1965)."
Ob Justice Roberts auch an andere Dylan-Zitate gedacht hat? Vielleicht: "A pay phone was ringing / It just about blew my mind" (Bob Dylan's 115th Dream), oder - noch einschlägiger - aus Long-Distance Operator:

"Long-distance operator,
Place this call, it's not for fun. ...
There are thousands in the phone booth,
Thousands at the gate.
Ev'rybody wants to make a long-distance call
But you know they're just gonna have to wait."

Und wenn dann Fälle zur Telefonüberwachung (warrantless wiretapping) zu entscheiden sind, könnte sich ein Zitat aus Subterranean Homesick Blues anbieten: "The phone's tapped anyway"
